Terms of Service

Last updated: October 2026. This agreement governs the procurement and manufacturing of goods from TitanForge Industrial.

1. Acceptance of Terms

By engaging TitanForge Industrial ("TitanForge", "we", "us") for manufacturing services, or by accessing our website at titanforgeindustrial.com, you agree to these Terms of Service. If you are entering into this agreement on behalf of a company, agency, or defense contractor, you represent that you have the authority to bind such entity.

2. Scope of Manufacturing

TitanForge provides heavy manufacturing, structural steel fabrication, 5-axis CNC machining, and ITAR-compliant defense component production. The specific deliverables, material specifications, tolerances, and costs for any engagement will be defined in a separate Purchase Order (PO) or Master Services Agreement (MSA) executed by both parties.

3. Material Sourcing & Compliance

All raw materials used by TitanForge are sourced domestically in compliance with the Buy American Act and the Berry Amendment. For defense contracts, we comply with DFARS specialty metals restrictions and provide full mill traceability and Certificates of Conformance (CoC) with every shipment.

4. Intellectual Property

You retain ownership of your proprietary designs, CAD files, and engineering drawings. TitanForge retains ownership of our manufacturing processes, tooling, and pre-existing intellectual property. We will not disclose your designs to third parties except as required to fulfill the order (e.g., material testing labs).

5. Quality Control and Acceptance

All parts are inspected to the tolerances specified in the PO. Non-conforming parts will be reworked or replaced at our expense. Final acceptance is deemed upon delivery, unless a dimensional inspection report is required by the PO.

6. Limitation of Liability

To the maximum extent permitted by law, TitanForge's total aggregate liability for any and all claims arising out of or relating to this agreement shall not exceed the total amount paid by you for the specific goods in question. TitanForge shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or infrastructure failure.

7. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
